1. Overview

This website is operated by Klevo LLC, a Missouri limited liability company doing business as Kirnia. Throughout these Terms of Service, “Kirnia,” “we,” “us,” and “our” refer to Klevo LLC and the Kirnia brand.

Kirnia provides this website, including its products, content, features and related services, subject to your acceptance of these Terms of Service.

By visiting our website, creating an account, placing an order or otherwise using our services, you agree to these Terms of Service and our Privacy Policy, Refund Policy and Shipping Policy.

If you do not agree to these terms, you should not use our website or place an order.

2. United States Sales Only

Kirnia currently accepts orders for delivery to eligible addresses within the United States only.

We do not currently offer international delivery. If an order is submitted with an ineligible or non-US delivery address because of a checkout error or unauthorized workaround, we may cancel and refund the order.

Certain US territories, military addresses, PO boxes, Alaska, Hawaii or remote areas may be subject to additional restrictions, delivery times or charges. Available shipping options will normally be displayed during checkout.

3. Eligibility

You must be at least 18 years old or the legal age of majority in your state to place an order.

By placing an order, you confirm that the information you provide is truthful and that you are authorized to use the selected payment method.

You may not use our website, products or services for fraudulent, unlawful or unauthorized purposes.

4. Products and Product Information

We make reasonable efforts to present our products accurately. However, colors, dimensions and appearance may vary slightly because of lighting, photography, manufacturing tolerances, product updates and differences between device displays.

Unless expressly stated otherwise, measurements and product specifications are approximate. Packaging, included accessories and minor product details may be updated without materially changing a product’s primary function.

Product images may include laptops, phones, tablets or other props for demonstration. Only the products and accessories expressly identified in the product description or selected offer are included.

Products may be available in limited quantities and may be modified, replaced or discontinued without notice.

5. General Wellness and Ergonomic Information

Information concerning comfort, posture, ergonomics or workplace positioning is provided for general informational purposes.

Kirnia products and website content are not intended to diagnose, treat, cure or prevent any disease, injury or medical condition. They are not substitutes for professional medical advice, diagnosis, treatment or an individualized ergonomic assessment.

Results and comfort may vary depending on the customer, device, workspace and manner of use. If you experience persistent pain, numbness, weakness or another health concern, consult an appropriately qualified healthcare professional.

References to workplace or ergonomic guidance do not mean that the referenced organization recommends or endorses Kirnia or its products.

6. Orders and Acceptance

An order confirmation means that we received your order. It does not necessarily mean that the order has been finally accepted or shipped.

We may reject, limit, hold or cancel an order because of suspected fraud, inaccurate information, inventory problems, payment failure, pricing errors, shipping restrictions, excessive quantities, suspected resale activity or other legitimate legal or operational concerns.

If we cancel an order after payment has been captured, we will issue a refund to the original payment method. Your bank or payment provider may require additional time to display the refund.

We may limit quantities purchased per person, household, customer account, payment method, billing address or shipping address.

7. Prices, Taxes and Errors

All prices are displayed in US dollars unless expressly stated otherwise.

Prices may change without notice. The price applicable to an accepted order is normally the price displayed during checkout, subject to correction of obvious technical or typographical errors.

Applicable taxes, shipping charges and other fees will be displayed during checkout where required.

If a displayed price is clearly incorrect because of a technical or system error, we may correct the error or cancel the affected order. If additional payment would be required, we will request your authorization before proceeding.

8. Payments and Shopify Payments

Kirnia uses Shopify Payments and other payment methods made available through Shopify checkout.

Klevo LLC, doing business as Kirnia, is the seller of products purchased from this website. Shopify and its applicable payment processors facilitate payment authorization, processing and settlement but do not replace Kirnia as the seller responsible for the products and customer service.

When you place an order, you authorize the applicable payment provider to charge the total amount displayed during checkout. A temporary payment authorization may appear before the charge is finally captured.

Shopify and applicable payment processors may process transaction information for payment authorization, fraud prevention, security, sanctions screening, regulatory compliance and other lawful purposes.

Available payment methods may change according to eligibility, location, device or payment-provider requirements. We do not guarantee that every payment method will always be available.

9. Fraud Prevention and Verification

We may use Shopify’s fraud-analysis tools and information supplied by payment processors or other service providers to identify potentially fraudulent or unauthorized transactions.

We may request reasonable verification before accepting or shipping an order. This may include confirming order details, billing information, shipping information or authorization to use the selected payment method.

We will not request your complete payment-card number, card security code or account password through ordinary email, text message or social media.

If we cannot reasonably verify an order, or if the transaction presents a significant risk of fraud or unauthorized payment, we may place it on hold or cancel it. Any captured payment will be refunded when required.

10. Chargebacks and Payment Disputes

If you do not recognize a charge or believe there is a problem with an order, please contact us promptly at support@kirnia.com so we can investigate and attempt to resolve it.

Nothing in these Terms removes any valid payment-dispute or chargeback rights provided by law or payment-network rules.

However, knowingly submitting false information, falsely claiming that an authorized purchase was unauthorized, or initiating a payment dispute after receiving and retaining the purchased products may constitute fraud.

We may provide payment processors, banks and card networks with relevant order records, customer communications, delivery confirmation, tracking information and other evidence reasonably necessary to respond to a dispute.

11. Promotions, Bundles and Free Gifts

Promotions, bundle discounts, quantity offers, free gifts and promotional prices may be subject to additional conditions displayed with the offer.

Unless stated otherwise, promotions cannot be combined, transferred, redeemed for cash or applied to previous purchases.

A product described as a “free gift” may be included as part of a product package or promotional offer and may not have a separately redeemable cash value.

If a qualifying purchase is returned, any associated promotional gift must also be returned when required under our Refund Policy. If the gift is not returned, we may deduct its stated or reasonable retail value from the refund where permitted by law and disclosed in our Refund Policy.

We may cancel or correct promotions affected by obvious errors, abuse, manipulation or unauthorized duplication.

12. Shipping and Delivery

Orders are shipped according to our Shipping Policy.

Delivery dates and transit times are estimates and are not guaranteed unless we expressly state otherwise. Delays may occur because of carrier disruptions, severe weather, remote-area delivery, security checks, demand or circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. We are not responsible for delays or losses caused primarily by an incorrect or incomplete address supplied by the customer, although we will provide reasonable assistance where possible.

Orders containing multiple products, bundle items or promotional gifts may arrive in separate packages.

When tracking shows delivery, customers should promptly check the delivery location, household members, neighbors and carrier records. Contact both the carrier and Kirnia promptly if the package cannot be found.

13. Cancellations, Returns and Refunds

Cancellations, returns, refunds, replacements, damaged-product claims and missing-item claims are governed by our Refund Policy.

Submitting a cancellation request does not guarantee cancellation if processing or fulfillment has already begun.

Approved refunds will normally be returned to the original payment method. We do not control how long a bank or payment provider takes to display a completed refund.

Nothing in these Terms limits consumer rights that cannot legally be waived.

14. Proper Product Use

You agree to use purchased products according to their instructions, warnings, intended purpose and reasonable safety precautions.

You are responsible for confirming that a product is suitable for your laptop, phone, tablet, workspace or other intended equipment before use.

Do not overload, misuse, improperly assemble or use a product with incompatible, unstable or damaged equipment.

To the extent permitted by law, Kirnia is not responsible for damage primarily caused by misuse, unauthorized modification, failure to follow instructions or use outside the product’s intended purpose.

15. Accuracy of Website Information

We attempt to keep our website accurate, but information may occasionally contain typographical errors, inaccuracies or omissions involving product descriptions, prices, promotions, shipping charges, delivery estimates or availability.

We may correct errors and update information when reasonably necessary. If a correction materially affects an order already placed, we will contact you or provide an appropriate cancellation or refund.

16. Customer Accounts

If you create a customer account, you are responsible for protecting your login information and restricting access to your account.

You agree to provide accurate and current information. Notify us promptly if you suspect unauthorized account activity.

We may suspend or terminate accounts used for fraud, abuse, unlawful conduct, repeated policy violations or interference with the website.

17. Prohibited Uses

You may not use the website to violate applicable law, infringe another person’s rights, transmit malicious software, obtain information without authorization, interfere with website security, impersonate another person, submit fraudulent orders or engage in abusive conduct.

You may not reproduce, scrape, resell or commercially exploit substantial portions of our website or content without written authorization.

We may restrict access or cancel associated orders when we reasonably believe the website is being misused.

18. Intellectual Property

The Kirnia name, logos, website design, product presentation, graphics, photographs, videos, written content and other original materials are owned by or licensed to Klevo LLC and are protected by applicable intellectual-property laws.

You may use our website for personal, non-commercial shopping purposes. You may not reproduce, distribute, modify, publish, sell, license or commercially exploit our content without prior written authorization.

Third-party trademarks and materials remain the property of their respective owners. Their appearance does not necessarily mean that they sponsor or endorse Kirnia.

19. Reviews and Customer Content

If you voluntarily submit a review, photograph, video, testimonial or other content, you confirm that you have the right to provide it and that it does not violate another person’s rights.

You grant Kirnia a non-exclusive, worldwide, royalty-free licence to display, reproduce and adapt the submitted content for operating, promoting and improving Kirnia, subject to applicable law and our Privacy Policy.

We may remove content that is unlawful, fraudulent, abusive, misleading, unrelated, infringes another person’s rights or exposes sensitive personal information.

We will not edit a genuine review in a manner that misrepresents the reviewer’s opinion.

20. Third-Party Services and Links

Our website may contain third-party applications, payment options, links or services that we do not own or control.

We are not responsible for the independent content, availability, security or privacy practices of third-party services. Their use may be governed by separate terms and policies.

By using Shopify checkout, you understand that Shopify and applicable payment processors may process transaction and payment information to provide payment services, prevent fraud and comply with legal and regulatory obligations.

22. Disclaimer of Warranties

To the fullest extent permitted by law, our website and its general content are provided on an “as available” basis. We do not guarantee that website access will always be uninterrupted, secure or error-free.

Products are subject to warranties expressly stated on the applicable product page or in our policies, together with any mandatory warranties provided under applicable law.

Nothing in these Terms excludes warranties, remedies or consumer protections that cannot lawfully be excluded.

23. Limitation of Liability

To the fullest extent permitted by applicable law, Klevo LLC, Kirnia and their officers, employees, contractors and service providers will not be liable for indirect, incidental, special, punitive or consequential losses arising from use of the website or products, including lost profits, lost revenue or lost data.

Where liability cannot be completely excluded, our aggregate liability relating to a particular order will not exceed the amount paid to Kirnia for the product or order giving rise to the claim.

These limitations do not apply to fraud, willful misconduct, gross negligence, personal injury caused by negligence or any liability that cannot legally be limited or excluded.

Some states do not allow particular exclusions or limitations. In those states, these provisions apply only to the maximum extent permitted by law.

24. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Klevo LLC and Kirnia from third-party claims and reasonable expenses arising from your unlawful misuse of the website, material violation of these Terms or infringement of another person’s rights.

This does not require you to indemnify Kirnia for Kirnia’s own negligence, unlawful conduct or breach of these Terms.

25. Events Outside Our Control

We are not responsible for delays or failures caused by events outside our reasonable control, including natural disasters, severe weather, war, civil unrest, epidemics, labor disruptions, transportation interruptions, carrier failures, power outages, internet failures, government actions or supply-chain disruptions.

We will make reasonable efforts to communicate material delays and fulfill affected obligations when reasonably possible.

26. Electronic Communications

By using our website, placing an order or contacting us electronically, you consent to receiving transactional communications electronically, including order confirmations, receipts, tracking updates, security notices and policy notices.

Electronic communications satisfy legal writing requirements to the extent permitted by law.

Marketing communications remain subject to your marketing preferences and applicable law.

27. Suspension and Termination

We may suspend or terminate access to the website when reasonably necessary because of fraud, unlawful conduct, security threats, abuse or material violation of these Terms.

Provisions that should reasonably survive termination—including payment obligations, intellectual-property provisions, disclaimers, liability limitations and dispute provisions—will remain effective.

28. Governing Law and Disputes

These Terms are governed by the laws of the State of Missouri and applicable federal laws of the United States, without regard to conflict-of-law principles.

Subject to mandatory consumer protections, legal proceedings arising from these Terms or an order shall be brought in an appropriate state or federal court serving St. Louis County, Missouri.

Before beginning formal proceedings, we encourage you to contact support@kirnia.com so both parties can attempt to resolve the matter in good faith.

29. Severability and Waiver

If any provision is determined to be invalid or unenforceable, it will be enforced to the maximum lawful extent or severed where necessary. The remaining provisions will continue in effect.

Our failure to enforce a provision on one occasion does not waive our right to enforce it later.

30. Entire Agreement

These Terms, the policies referenced in them and any specific terms displayed with a product or promotion constitute the agreement between you and Kirnia concerning use of the website and purchase of products.

If specific promotional or product terms conflict with these general Terms, the more specific terms apply to that particular offer or product.

31. Changes to These Terms

We may update these Terms to reflect changes in our services, payment methods, business practices or legal obligations.

The current version will be posted on this page with an updated effective date. Changes apply prospectively unless applicable law requires otherwise.

The Terms in effect when an order is placed will generally govern that order.
